Enforcing A Medical Device Patent – Definiteness And Induced Infringement

The lecture will review a recent court decision by the CAFC in Niazi Licensing Corp. v. St. Jude Medical S.C. Inc.. This case illustrates two important issues in medical device patents (1) whether seemingly ordinary terms like “resilient” and “pliable” can render a patent claim invalid as being indefinite and (2) the importance of presenting multi-step method of use claims that cover possible variations in which the order of method steps are performed.
