Patent Eligibility of User Authentication: A Review of CosmoKey Solutions v. Duo Security

This lecture will review the Federal Circuit Opinion of CosmoKey Solutions v. Duo Security, No. 2020-2043 (Fed. Cir. 2021). In CosmoKey, the issue is whether a user authentication method disclosed in U.S. Patent No.: 9,246,903 is patent eligible under 35 U.S.C. § 101. This process involves authenticating the identity of a user performing a transaction at a terminal (e.g., a computer or other device) by activating an authentication function on the user’s mobile terminal.
