Sonos v. Google - The Next Generation of Prosecution Laches

This lecture will discuss Sonos v. Google and the next generation of prosecution laches.
In a case on appeal to the Federal Circuit, two patents asserted by Sonos were found unenforceable for prosecution laches. In a patent having a 20 year term from the filing date, the “unreasonable and unexplained delay in prosecution” was not the result of an Applicant creating delay in the examination of an application, but the filing of a continuation 13 years after the earliest effective filing date.
